Abstract

The road one of the main facilities as a traffic route for vehicle, mobility and as the main support for national development and equity. Development is one of acces to civilzation velocity from a city to the provinces to the help economic, education and productive activities to build prosperity region decreased unemployed and social inequality. With the increasing population, there is a need for adequate road use the road user. There are a few regions that far from the goverment that need more affection to build good insfrastructure. With the existence of roads that are not feasible to pass, then vehivles crossing the road will be hampered, an there will be many problems that arise for improper road conditions. Loss both materially and immaterially. Because of that, the role of government is urgently needed to address road problems that are faulty and unworthy to motor-vehicleg drivers. Thus in writing this journal the authors discuss the problem in perspective, the lack of legal protection resulting from roads that were damaged. In article 273 of 2009, section 273 of legislation no. 22 concerning road traffic and road transport is stated that it is necessary to repair faulty roads that lead to traffic accidents and that lead to criminal liability. Given article 273 legislation law no 22 in 2009 that it is the administration, in the sense that it is the government that is fully responsible for the safety of road workers, so in the event of an accident of a faulty and undeserved road, resulting in the fall of casualties, then by the rule of article 273 of the year 2009 government in this case as the road operator, The victim could then file a lawsuit against the government.
