Implementasi Upaya Penjaminan Hak Perempuan dan Anak Pasca Perceraian di Pengadilan Agama Surabaya

The background of this study focused on the importance of protecting the rights of women and children after divorce, considering the significant impact on their lives, both economically, socially, and psychologically. Although there are efforts to ensure rights guarantee in Indonesia, the implementation often faces various challenges. This study aimed to describe the implementation of efforts to guarantee the rights of women and children after divorce at the Surabaya Religious Court and to identify the factors that influence the effectiveness of this implementation. The formulation of the problems proposed are (1) how is the implementation of efforts to guarantee the rights of women and children after divorce at the Surabaya Religious Court and (2) what are the factors that influence the effectiveness of this implementation. This study uses a descriptive qualitative approach to understand the phenomena that occur with data collection techniques through interviews, observations, and documentation studies. The results showed that (1) the Surabaya Religious Court has implemented various efforts to guarantee the rights of women and children after divorce, such as including the obligation to provide support in the verdict. (2) The efforts of the Surabaya Religious Court include collaborating with external parties and providing programs and facilities such as RaHMA, FEMINA, and the SIWAS application. However, there are still challenges in achieving optimal protection. Factors influencing implementation effectiveness include external collaboration, resource capacity, and existing technology support.
