Prinsip Keadilan Ekonomi Praktik Akad Murabahah: Studi pada Koperasi Keuangan Desa Banprew, Songkhla, Thailand

Penelitian ini bertujuan untuk menganalisis praktik akad murabahah pada Koperasi Keuangan Desa Banprew, Kecamatan Thamosai, Kabupaten Chana, Provinsi Songkhla, Thailand serta mengevaluasi penerapan prinsip keadilan berdasarkan perspektif hukum ekonomi syariah. Fokus penelitian meliputi mekanisme pembiayaan murabahah, implementasi prinsip keadilan dalam hubungan antara koperasi dan anggota, serta dampaknya terhadap kesejahteraan sosial-ekonomi anggota dan keberlanjutan usaha koperasi. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian studi kasus. Data diperoleh melalui wawancara mendalam, observasi partisipatif, dan studi dokumentasi. Analisis data dilakukan menggunakan analisis tematik melalui tahapan reduksi data, kategorisasi, interpretasi, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa praktik akad murabahah di Koperasi Keuangan Desa Banprew telah menerapkan prinsip-prinsip dasar syariah berupa keterbukaan akad, kesepakatan para pihak, dan kepastian pembayaran. Penerapan prinsip keadilan tercermin dalam adanya transparansi informasi pembiayaan, kesepakatan margin keuntungan, serta perlindungan terhadap hak anggota. Namun demikian, masih ditemukan beberapa aspek yang memerlukan penguatan, terutama terkait optimalisasi pemahaman anggota terhadap akad, dokumentasi transaksi, dan peningkatan transparansi dalam proses pembiayaan. Dari perspektif hukum ekonomi syariah, praktik murabahah yang diterapkan pada dasarnya telah sejalan dengan prinsip al-'adl (keadilan), an- taradhin (kerelaan), dan kemaslahatan, meskipun diperlukan upaya penyempurnaan untuk memastikan terwujudnya keadilan substantif secara lebih optimal. Penerapan prinsip keadilan tersebut berkontribusi terhadap peningkatan kepercayaan anggota, kesejahteraan sosial-ekonomi masyarakat, dan keberlanjutan operasional koperasi.

This study aimed to analyse the practice of murabahah contracts at the Banprew Village Financial Cooperative in Thamosai District, Chana, Songkhla, Thailand, and to evaluate the application of justice principles from a sharia economic law perspective. The research focused on the murabahah financing mechanism, the implementation of justice principles in the relationship between the cooperative and its members, and the impact on members’ socio-economic welfare and the sustainability of the cooperative’s business. This study used a qualitative case study design. Data were obtained through in-depth interviews, participant observation, and documentation studies. Data analysis was conducted using thematic analysis through the stages of data reduction, categorization, interpretation, and conclusion drawing. The research results indicated that the murabahah contract practice at the Banprew Village Financial Cooperative has implemented basic sharia principles, including contract transparency, mutual agreement, and payment certainty. The application of the principle of justice was reflected in the transparency of financial information, agreed-upon profit margins, and the protection of members’ rights. However, several aspects still require strengthening, particularly regarding optimizing members’ understanding of the contract and transaction documentation and increasing transparency in the financing process. From a sharia economic law perspective, the murabahah practice was fundamentally aligned with the principles of al-‘adl (justice), an-taradhin (consent), and kemaslahah (benefit). However, improvements are needed to ensure optimal substantive justice. The implementation of this principle of justice contributes to increased member trust, community socio-economic welfare, and the sustainability of the cooperative’s operations.
