Tinjauan Yuridis Wakaf Tanah Oloran di Wilayah Pesisir

Tanah oloran merupakan tanah hasil sedimentasi di wilayah pesisir yang sering dimanfaatkan sebagai objek wakaf, namun secara yuridis masih berstatus tanah negara sehingga menimbulkan ketidakpastian hukum. Penelitian ini bertujuan menganalisis prosedur administrasi hukum tanah oloran serta kepastian hukum wakafnya. Metode yang digunakan adalah yuridis-normatif dengan pendekatan perundang-undangan dan konseptual melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa legalitas wakaf tanah oloran bergantung pada status hak atas tanah, prosedur pendaftaran, serta integrasi administrasi pertanahan dan wakaf. Tanpa kepastian hukum, wakaf berpotensi menimbulkan sengketa. Oleh karena itu, diperlukan penguatan regulasi untuk menjamin kepastian dan perlindungan hukum wakaf.

Oloran land is coastal land formed through natural sedimentation that is often utilized as waqf property. However, from a legal perspective, it remains classified as state land, resulting in legal uncertainty. This study aims to analyze the legal administrative procedures governing oloran land and the legal certainty of its waqf status. The research employs a normative juridical method using statutory and conceptual approaches through library research. The findings indicate that the legality of waqf involving oloran land depends on the legal status of the land rights, land registration procedures, and the integration of land administration and waqf administration. In the absence of legal certainty, such waqf may give rise to legal disputes. Therefore, strengthening the regulatory framework is necessary to ensure legal certainty and legal protection for waqf involving oloran land.
