Abstract

Tanah kavling merupakan bagian tanah yang berasal dari pemecahan tanah induk untuk diperjualbelikan kepada masyarakat, baik untuk kebutuhan hunian maupun investasi. Dalam praktik pertanahan di Indonesia, transaksi jual beli tanah kavling sering dilakukan sebelum terbit sertifikat hak atas tanah atas nama pembeli. Kondisi tersebut menimbulkan persoalan hukum karena sertifikat merupakan alat bukti hak yang kuat sebagaimana diatur dalam Undang-Undang Pokok Agraria dan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah. Data Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional menunjukkan bahwa sengketa dan konflik pertanahan masih terjadi dalam jumlah tinggi, sehingga menunjukkan bahwa kepastian hukum pertanahan belum sepenuhnya terwujud, khususnya terhadap tanah kavling yang belum bersertifikat.Penelitian ini bertujuan untuk menganalisis kepastian hukum bagi pembeli tanah kavling yang belum bersertifikat berdasarkan Undang-Undang Pokok Agraria serta mengkaji bentuk perlindungan hukum bagi pembeli berdasarkan Kitab Undang-Undang Hukum Perdata melalui mekanisme wanprestasi dan perbuatan melawan hukum. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum diperoleh melalui studi kepustakaan dan dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa pembeli tanah kavling yang belum bersertifikat belum memperoleh kepastian hukum karena hak atas tanah belum terdaftar secara resmi dan sertifikat belum terbit atas nama pembeli. Perlindungan hukum yang tersedia bersifat represif melalui gugatan wanprestasi dan perbuatan melawan hukum, namun perlindungan tersebut hanya memberikan hak personal berupa ganti rugi dan tidak memberikan hak kebendaan atas tanah. Oleh karena itu, pendaftaran tanah dan penerbitan sertifikat menjadi instrumen utama dalam mewujudkan kepastian hukum bagi pembeli tanah kavling di Indonesia.

Land lots are parcels of land created by subdividing a parent plot for sale to the public, whether for residential purposes or investment. In land practices in Indonesia, the sale and purchase of land lots often takes place before a land title certificate is issued in the buyer’s name. This situation raised legal issues because the certificate serves as strong evidence of ownership, as stipulated in the Basic Agrarian Law and Government Regulation No. 24 of 1997 on Land Registration. Data from the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency indicated that land disputes and conflicts continue to occur at a high rate, suggesting that legal certainty regarding land has not yet been fully realized, particularly concerning land plots that are not yet certified. This study aims to analyze legal certainty for buyers of uncertified land plots based on the Basic Agrarian Law and to examine forms of legal protection for buyers under the Civil Code through the mechanisms of breach of contract and tort. The research method used is normative legal research employing a statutory approach and a conceptual approach. Legal materials were obtained through a literature review and analyzed using qualitative descriptive methods. The results of the study showed that buyers of uncertified land lots have not yet obtained legal certainty because their land rights have not been officially registered and certificates have not been issued in the buyers’ names. The available legal protections are of a punitive nature through claims for breach of contract and tort, but these protections only grant personal rights in the form of damages and do not confer property rights over the land. Therefore, land registration and the issuance of certificates are the primary instruments for achieving legal certainty for buyers of land lots in Indonesia.
