Abstract

Penelitian ini bertujuan untuk menganalisis dan membandingkan implementasi prinsip-prinsip syariah dalam operasional perbankan syariah di Indonesia (BSI) dan Thailand, dengan mengambil Bank Syariah Indonesia (BSI) dan Bank Islamik Thailand (IBank) sebagai objek kajian. Penelitian ini menggunakan pendekatan hukum normatif-komparatif dengan metode deskriptif-komparatif melalui studi kepustakaan (library research). Data bersumber dari regulasi primer (Undang-Undang Nomor 21 Tahun 2008, Islamic Bank of Thailand Act 2002, Fatwa DSN-MUI, POJK), laporan tahunan BSI dan IBank tahun 2020–2024, standar internasional AAOIFI-GS8 dan IFSB-10, serta literatur akademik yang relevan.
Hasil penelitian menunjukkan tiga temuan utama. Pertama, Indonesia menerapkan model tata kelola syariah tiga tingkat yang saling mendukung, yakni DSN-MUI sebagai otoritas fatwa nasional yang independen, OJK sebagai regulator formal, dan DPS sebagai pengawas tingkat institusi yang memiliki kewenangan formal dan kewajiban pelaporan. Thailand sebaliknya menerapkan model satu tingkat berbasis legislasi negara, di mana Shariah Advisory Board (SAB) IBank hanya berperan sebagai penasihat konsultatif internal tanpa otoritas syariah nasional yang setara. Kedua, kerangka hukum Indonesia yang berlapis memberikan kepastian hukum yang lebih kuat atas akad syariah, didukung oleh keberadaan Pengadilan Agama yang memahami hukum Islam. Thailand menghadapi risiko hukum yang signifikan karena pengadilan sipilnya kerap menafsirkan transaksi syariah seperti murabahah sebagai “bunga” dalam hukum perdata konvensional. ketiga, ekosistem fatwa DSN-MUI yang adaptif memungkinkan BSI menawarkan portofolio produk yang sangat beragam mencakup berbagai akad utama (mudharabah, musyarakah, murabahah, ijarah, IMBT) termasuk produk digital berbasis fatwa. IBank sebaliknya terkonsentrasi pada akad murabahah akibat ketiadaan mekanisme fatwa nasional dan ketidakpastian hukum.
Penelitian ini menyimpulkan bahwa tidak terdapat “model terbaik universal” dalam tata kelola syariah; kinerja suatu model sangat bergantung pada kesesuaiannya dengan konteks demografis, sistem hukum, dan kapasitas kelembagaan setempat. Model Indonesia yang berbasis otoritas keagamaan independen sangat efektif dalam konteks negara mayoritas Muslim, sementara model Thailand merupakan adaptasi realistis dalam konteks negara mayoritas non-Muslim. Penelitian ini merekomendasikan penguatan kapasitas DPS pada bank syariah kecil di Indonesia, amandemen undang-undang IBank Thailand untuk memperkuat status SAB, serta harmonisasi standar tata kelola syariah di tingkat ASEAN.

This study aims to analyze and compare the implementation of sharia principles in Islamic banking operations in Indonesia and Thailand, using Bank Syariah Indonesia (BSI) and Islamic Bank of Thailand (IBank) as the objects of study. This research employs a normative-comparative legal approach using descriptive- comparative methods through library research. Data are sourced from primary regulations (Law No. 21 of 2008, Islamic Bank of Thailand Act 2002, DSN-MUI Fatwas, OJK Regulations), BSI and IBank annual reports from 2020–2024, AAOIFI-GS8 and IFSB-10 international standards, and relevant academic literature. The findings reveal three key conclusions. First, Indonesia employs a three-tier sharia governance model — DSN-MUI as an independent national fatwa authority, OJK as the formal regulator, and DPS as institution-level supervisors with formal authority and reporting obligations. Thailand, in contrast, applies a single-tier model based on state legislation, where the Shariah Advisory Board (SAB) of IBank serves only as an internal consultative body without an equivalent national sharia authority. Second, Indonesia’s multi-layered legal framework provides stronger legal certainty for sharia contracts, supported by the Religious Courts (Pengadilan Agama) specializing in Islamic economic law. Thailand faces significant legal risk as its civil courts often interpret sharia transactions such as murabahah as conventional “interest.” Third, the adaptive DSN-MUI fatwa ecosystem enables BSI to offer a highly diversified product portfolio encompassing various key contracts (mudharabah, musyarakah, murabahah, ijarah, IMBT), including fatwa- based digital products. IBank, by contrast, remains concentrated in murabahah- based products due to the absence of a national fatwa mechanism and pervasive legal uncertainty. The study concludes that there is no universally superior model of sharia governance; the effectiveness of a model is highly contingent on its alignment with the demographic context, legal system, and institutional capacity of each country. The Indonesia model—grounded in an independent religious authority—is highly effective in a Muslim-majority context, while Thailand’s model represents a realistic adaptation within a non-Muslim-majority state. This study recommends strengthening DPS capacity in smaller Islamic banks in Indonesia, amending the IBank Act to enhance the SAB’s supervisory authority, and advancing harmonization of sharia governance standards at the ASEAN level.
