Analisis Normatif Pendaftaran Tanah Sistematis Lengkap dalam Perspektif Kepastian Hukum

Pendaftaran Tanah Sistematis Lengkap merupakan program strategis nasional yang diselenggarakan negara dalam rangka mewujudkan kepastian hukum hak atas tanah. Penelitian ini bertujuan menganalisis konstruksi hukum Pendaftaran Tanah Sistematis Lengkap untuk menguji konsistensinya terhadap kepastian hukum dan perlindungan hak atas tanah dalam sistem pendaftaran tanah di Indonesia. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan (statute approach) menggunakan analisis terhadap Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria, Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah, Instruksi Presiden Nomor 2 Tahun 2018, serta Peraturan Menteri ATR/BPN Nomor 6 Tahun 2018. Hasil penelitian menunjukkan bahwa Pendaftaran tanah sistematis lengkap memiliki landasan hukum yang sistematis dan koheren serta diposisikan sebagai instrumen yuridis negara untuk menjamin kepastian hukum mengenai status hak, subjek hukum, dan objek hak atas tanah. Namun demikian, dalam kerangka sistem publikasi negatif yang bertendensi positif, kepastian hukum yang dihasilkan tidak bersifat mutlak apabila tidak didukung oleh akurasi dan validitas data fisik serta data yuridis. Oleh karena itu, keberhasilan pendaftaran tanah sistematis lengkap tidak hanya diukur dari jumlah sertipikat yang diterbitkan, melainkan dari kualitas proses verifikasi, integritas basis data pertanahan, serta kemampuannya mewujudkan kepastian hukum yang bukan terbatas dari capaian administratif berupa jumlah sertifikat yang diterbitkan.

Complete Systematic Land Registration is a national strategic program implemented by the state to achieve legal certainty over land rights. This study aims to analyze the legal construction of Complete Systematic Land Registration to test its consistency with regard to legal certainty and land rights protection within the Indonesian land registration system. This study uses a normative legal research method with a statute approach, analyzing Law Number 5 of 1960 concerning Basic Agrarian Regulations, Government Regulation Number 24 of 1997 concerning Land Registration, Presidential Instruction Number 2 of 2018, and Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 6 of 2018. The results indicate that Complete Systematic Land Registration has a systematic and coherent legal basis and is positioned as a state juridical instrument to ensure legal certainty regarding the status of rights, legal subjects, and objects of land rights. However, within the framework of a negative publication system with a positive tendency, the resulting legal certainty is not absolute if it is not supported by the accuracy and validity of physical and legal data. Therefore, the success of comprehensive, systematic land registration is measured not only by the number of certificates issued, but also by the quality of the verification process, the integrity of the land database, and its ability to achieve legal certainty beyond administrative achievements in the form of the number of certificates issued.
