OVERCROWDING LEMBAGA PEMASYARAKATAN (LAPAS) DALAM SYSTEM PEMIDANAAN DI INDONESIA

Correctional institutions are part of the correctional system to form correctional inmates so that they can
be accepted again by the community. Along with the increase in inmates entering prisons, many
correctional institutions experience overcrowding due to the disproportionate relationship between prison
residents and the occupancy capacity in prisons. This study aims to describe directly the right solution for
solving the problem of excess capacity in prisons in Indonesia and to find out the regulatory policies that
have been taken in dealing with this problem. For this reason, through empirical juridical research
methods with research focused on matters of a juridical nature and existing realities and through a sociolegal
approach to answer problems due to social injustice. Then, the data needed is secondary data with the
data collection method carried out by library research. Secondary data taken include primary legal
materials and secondary legal materials. The results of the study indicate that there are several factors that
influence overcrowding conditions and also the sustainability of policies that are still not significant in
contributing to reducing the number of overcrowded.
